Separation Agreements.

 

If you were never married or you are married but not divorcing as part of your separation, then the court will not approve a consent order.  The next best option is to have a separation agreement drawn up.

The separation agreement will set out the terms of the settlement agreed and ask the court to dismiss any further court applications made by the parties in breach of that agreement. 

While this is not legally binding on the courts, it is good evidence and the courts will often follow a separation agreement which achieves a fair settlement and was entered into properly.
