Pre-nuptial agreements and post-nuptial agreements are not legally binding under English law, but as is the case with separation agreements, the courts may choose to follow them if they achieve a fair settlement and are entered into properly. 

A pre- or post-nuptial agreement can also be good evidence of your position on entering into a marriage, and can help assist with any contribution arguments or pre-marital assets arguments.
